These Terms of Service (“Terms”) govern your use of Flypost, including the website at https://www.flypost.io, the application at https://app.flypost.io, our MCP server and integrations, and any related services (together, the “Service”). The Service is provided by Toksta Solutions LTD, a company registered in England and Wales (number 13018428), whose registered office is at 124 City Road, London, England, EC1V 2NX (“we”, “us” or “our”).
By creating an account, starting a trial, or using the Service, you agree to these Terms, our Cancellations & refunds policy and, if you are a business, our Data Processing Addendum. Our Privacy Policy and Cookie Policy explain how we handle personal data. If you do not agree, do not use the Service.
Key points
- You own what you put into Flypost and what it writes for you.
- We do not use your content to train AI models.
- AI output can be wrong. You review and approve everything before it is published.
- Paid plans renew automatically until you cancel. You can cancel at any time in the app, and you keep access until the end of the period you paid for.
- Charges appear on your statement as “Toksta”, the company behind Flypost. If a charge looks wrong, email hello@flypost.io and we will sort it out.
1. Who can use the Service
You must be at least 18 and able to enter a binding contract. If you use the Service for a company or other organisation, you confirm that you are authorised to accept these Terms for it, and “you” includes that organisation.
Flypost is built for professionals and businesses. Some parts of these Terms apply differently if you are a consumer, meaning an individual acting wholly or mainly outside your trade, business, craft or profession. Where that is the case, we say so. Nothing in these Terms affects the rights you have as a consumer that cannot be excluded by contract.
2. The Service
Flypost helps you create, manage and publish LinkedIn content. Features include AI-assisted writing, a knowledge base built from your own material (the “Brain”), carousels, images and infographics, inspiration from creators you choose to follow, scheduling and publishing, post analytics, team collaboration and connections to AI assistants. Features vary by plan and are described on our pricing page.
We keep improving the Service and may add, change or remove features. If we remove a feature that is a core part of the plan you pay for, we will tell you in advance and, if you cancel because of it, refund any prepaid amount for the period after the change.
Features labelled beta, preview or experimental are provided to try out. They may change, be withdrawn or not work as expected, and the service-level commitments in section 12 do not apply to them.
3. AI-generated content
The Service uses artificial intelligence models from third-party providers to generate text, images and other material (“Output”). You should know that:
- Output can be inaccurate. AI can state things that are false, misread your source material, or present an invented figure as fact. We take steps to ground Output in your own sources, but you must check facts, figures, quotes and names before you publish.
- You approve what is published. Nothing is published to LinkedIn unless you, or a team member you have authorised, schedules or publishes it. You are responsible for content published from your account, including making sure it is accurate, lawful and compliant with LinkedIn's rules and any rules that apply to your profession or industry.
- Output may not be unique. AI models can produce similar Output for different users, especially from similar inputs. We do not guarantee that Output is original or that no one else has a similar post.
- No guarantee of results. We share data and research on what tends to work on LinkedIn, but we do not guarantee reach, engagement, followers, leads or any other outcome.
4. Accounts, teams and projects
Keep your login details secure and tell us at hello@flypost.io if you think someone else has accessed your account. You are responsible for activity under your account. You may sign in with email and password or with Google, and we may ask you to complete security checks, such as bot protection.
Projects. Content is organised into projects, each with its own brand settings, sources and Brain. Agency plans let you run projects for several brands or clients.
Team members. The account holder who pays for a plan is the owner. Owners can invite team members into their projects and choose what they can do. Team members can see and edit the content of projects they are invited to. The owner is responsible for who they invite and for their team's use of the Service. If a team member leaves, the owner can remove them; content they created stays in the project.
Working for clients. If you use Flypost to create content for clients (for example as an agency, consultant or ghostwriter), you are responsible for having your clients' permission to upload their material, connect their accounts and publish on their behalf. As between you and us, you are the customer and your clients are not parties to these Terms. Our Data Processing Addendum covers personal data we process for you.
5. Plans, trials and payment
- Prices. Prices and plan limits are shown on our pricing page and at checkout. Prices are in US dollars unless shown otherwise. Taxes, where they apply, are added at checkout.
- Free trial. New customers can try a paid plan free for 7 days. A card is required. Unless you cancel before the trial ends, your subscription starts and your card is charged automatically. One trial per customer.
- Automatic renewal. Subscriptions renew at the end of each monthly or yearly billing period, at the then-current price for your plan, until you cancel.
- Price changes. We will give you at least 30 days' notice by email before a price increase applies to you. If you do not want to pay the new price, you can cancel before it takes effect.
- Discounts. Promotional discounts apply for the period stated in the offer and cannot be combined unless we say so. When the period ends, the standard price applies.
- Payments. Payments are processed by Stripe. Charges appear on your bank or card statement under our company name, Toksta. Invoices and receipts are available in the billing portal.
- Fair use. Plans do not meter posts or AI usage in ordinary use. To keep the Service sustainable, each plan includes a monthly allowance for compute-heavy features such as AI image generation. If you reach it, those features pause until your next billing period or until you upgrade; writing and publishing continue. We may also limit use that is automated, resold or far beyond what a person or team would reasonably create.
6. Cancellation and refunds
You can cancel at any time from Plans & billing in the app. Cancellation takes effect at the end of your current billing period, and you keep access until then. If you are charged after a free trial or for an annual plan and change your mind, you can ask for a full refund within 7 days of that charge. Other payments are generally not refunded for partial periods. Our Cancellations & refunds policy sets out the details, including how we handle billing mistakes, failed payments and payment disputes, and forms part of these Terms.
If you are a consumer in the UK or EU, you have a right to cancel within 14 days of entering into a subscription. Because you ask us to start the Service immediately, if you cancel in that period we may deduct an amount proportionate to the Service provided before you told us you were cancelling. Where our refund policy gives you more, it applies instead.
7. Acceptable use
You must not use the Service to:
- break the law, or create or publish content that is defamatory, fraudulent, harassing, hateful, discriminatory or sexually explicit;
- infringe anyone's intellectual property, privacy or confidentiality, including uploading material you are not entitled to use;
- impersonate another person or organisation, or publish to an account you are not authorised to use;
- mislead people, for example by inventing testimonials, credentials, statistics or endorsements, or by hiding paid promotion where disclosure is required;
- send spam or bulk unsolicited messages, or artificially inflate engagement;
- break LinkedIn's User Agreement or Professional Community Policies, or the rules of any other platform you connect;
- scrape, copy or resell the Service or its data, or use it to build a competing product;
- reverse engineer, overload or interfere with the Service, or get around its security, usage limits or plan restrictions;
- share a single seat between several people, or let people outside your organisation use your account, beyond what your plan allows;
- upload malware, or special category data (such as health data) unless you have a lawful basis and it is necessary for your content.
When you use inspiration features, the posts you see belong to their authors. Use them to learn what works, not to copy them.
8. Your content
You own your content. “Your Content” means everything you or your team upload, connect or enter (such as brand details, documents, website and video sources, notes and drafts) and the Output generated for you. As between you and us, you own Your Content. To the extent we have any rights in Output generated for you, we assign them to you.
Our limited licence. You give us a non-exclusive, worldwide licence to host, store, process, copy and display Your Content only as needed to provide, secure and support the Service for you and the people you share it with. This licence ends when Your Content is deleted from the Service, except for copies in backups, which are overwritten on a rolling basis.
No training. We do not use Your Content to train or fine-tune AI models, and we do not sell it or license it to anyone else. To generate Output we send the relevant parts of Your Content to the AI providers listed in our Privacy Policy, which process it to return a response.
Confidentiality. We treat Your Content as confidential. Our staff and contractors access it only where needed to provide the Service, to give you support you have asked for (including our done-for-you services), to investigate a technical problem, or to keep the Service secure and lawful. They are bound by confidentiality obligations.
Your responsibility. You confirm you have the rights and permissions needed for Your Content, including permission from anyone whose personal data, image or words it contains, and that our use of it under these Terms will not infringe anyone's rights.
Usage data. We may use aggregated, de-identified data about how the Service is used (for example, which features are used and how published posts perform on average) to run and improve the Service and to publish research. It never identifies you, your clients or Your Content.
9. LinkedIn and other connected services
You can connect LinkedIn and other services such as Google Drive. When you do, you authorise us to access and use data from those services as needed for the features you use, such as publishing, analytics and importing sources. We publish to LinkedIn through LinkedIn's official APIs, using a third-party publishing provider. You can disconnect an account at any time.
Connected services are run by others under their own terms. We are not responsible for their availability, for changes to their APIs that affect our features, or for actions they take on your account. You are responsible for following their rules.
10. AI assistants and the MCP server
You can connect Flypost to AI assistants such as ChatGPT or Claude. A connected assistant can read and change your Flypost content in the projects you belong to, and can schedule or cancel posts, when you ask it to. You are responsible for what you ask it to do. The assistant is provided by a third party under its own terms, and any charges it makes are between you and that provider. You can disconnect it at any time.
11. Done-for-you services
If you buy a done-for-you package, our team (which may include contractors working under confidentiality obligations) uses Flypost to prepare content for you. The scope, price and commitment are set out in the offer you accept. Unless the offer says otherwise, we send you content to approve and nothing is published without your approval. Once you approve a post, it is your content and your responsibility, in the same way as anything else you publish.
We may send posts for approval as a private review link that works without signing in. Anyone who has the link can approve, edit or reject the posts in it, and approving a post schedules it to your LinkedIn account, so do not forward the link to anyone you would not trust to do that. Links expire, and we close them once the batch is done.
12. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may need to carry out maintenance, and parts of the Service depend on third parties such as AI providers and LinkedIn. Support is available by email at hello@flypost.io.
Please keep your own copies of important content. You can copy, download or export your posts and generated assets from the Service.
13. Our intellectual property and feedback
We and our licensors own the Service, including its software, design, templates, research and branding. These Terms give you the right to use the Service while your account is active, not any ownership of it.
If you send us ideas or feedback, we may use them to improve the Service without owing you anything. We will not identify you publicly as their source without your permission.
14. Suspension and termination
You can stop using the Service and cancel at any time. You can delete individual projects in the app, and we will delete your whole account if you ask us to; see our Privacy Policy for what happens to your data.
We may suspend or close your account if you seriously or repeatedly break these Terms, do not pay, use the Service in a way that risks harm to us, other users or third parties, or if we are required to by law. Where reasonable, we will warn you first and give you a chance to fix the problem. If we close your account without you being at fault, or because we stop providing the Service, we will give you at least 30 days' notice, the chance to export your content, and a refund of any prepaid amount for the period after closure.
Sections that by their nature should continue after termination continue, including sections 8 and 13 to 19.
15. Disclaimers
Apart from what we expressly promise in these Terms, the Service is provided “as is” and “as available”. To the extent the law allows, we exclude all implied terms, conditions and warranties, including as to satisfactory quality, fitness for a particular purpose and non-infringement, and we do not promise that Output will be accurate, complete or suitable for your purposes. If you are a consumer, the services we supply must be performed with reasonable care and skill, and this section does not affect that.
16. Our liability to you
What we never limit. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
If you are a business: we are not liable for loss of profits, revenue, business, goodwill, anticipated savings or data, or for any indirect or consequential loss. Our total liability arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence) or otherwise, is limited to the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the claim, or (b) US$100.
If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable. Because the Service is for professional use, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
We are not responsible for content you publish, for decisions made by LinkedIn or another platform about your account or content, or for delays and failures caused by events outside our reasonable control.
17. Indemnity (business customers)
If you are a business, you will compensate us for reasonable losses and costs (including reasonable legal fees) arising from a third-party claim that Your Content, or your use of the Service in breach of these Terms or the law, infringes that third party's rights. We will tell you promptly about any such claim and let you take part in handling it.
18. Changes to these Terms
We may update these Terms, for example to reflect new features or changes in the law. For material changes we will email you at least 30 days before they take effect. If you do not agree, you can cancel before then and we will refund any prepaid amount for the period after the change. Minor changes, such as clarifications or corrections, take effect when we publish them.
19. General
- These Terms, and the documents they refer to, are the whole agreement between you and us about the Service.
- If you refer customers to Flypost as an affiliate, our Affiliate Programme Terms also apply.
- We may transfer this agreement to another organisation, for example if our business is sold. We will tell you and your rights will not be reduced. You may transfer it only with our written agreement.
- If a court finds part of these Terms unenforceable, the rest still applies.
- If we do not enforce a right straight away, we can still enforce it later.
- No one other than you and us has any right to enforce these Terms.
- We may send you notices about your account, billing or these Terms by email to the address on your account, or in the app.
20. Governing law and disputes
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and if you live in the EU you keep the protection of the mandatory laws of your country and may bring proceedings there.
If you have a complaint, please contact us first at hello@flypost.io. Most problems are solved quickly that way.
